You grant us a worldwide, non-exclusive license to host, process, transmit, and use Customer Content solely to provide, maintain, secure, and improve the Service, and to respond to support requests. We may use de-identified and aggregated information derived from Customer Content for analytics and service improvement.

9. Marketing and References

We may use your name (and, if applicable, your logo) to identify you as a customer in our website, marketing materials, press releases, social media posts, and blog posts.

If you want us to stop, contact us and we will make reasonable efforts to remove future references.

  • your use risks harm to the Service, other users, or third parties
  • we are required to do so by law or to comply with sanctions or regulatory requirements

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE".
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to the Service.
  • Our total liability for all claims arising out of or relating to the Service will not exceed the amount of Fees actually paid by you to us for the Service in the 3 months preceding the event giving rise to the claim, or USD 100 if you have not paid any Fees, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Service or API in violation of these Terms or applicable law
  • your Customer Content
  • your violation of third-party rights, including privacy, intellectual property, or contractual rights
  • your products or services that integrate with or rely on the Service or API

We may assume control of the defense of any indemnified claim, and you agree to cooperate.

17. Governing Law and Dispute Resolution

17.1 Informal resolution first

If you have a dispute, you agree to first attempt to resolve it informally by contacting us at: [email protected]

17.2 Governing law

These Terms are governed by the laws of Singapore, excluding conflict of law rules.

17.3 Venue

If a dispute is not resolved informally, you agree that courts located in Singapore will have exclusive jurisdiction, unless mandatory consumer protection laws in your country of residence provide otherwise.

17.4 EU consumers

If you are a consumer residing in the European Union, you benefit from any mandatory provisions of the law of your country of residence.

18. Changes to These Terms

We may modify these Terms at any time by posting the updated version on the Service (and, where appropriate, by additional notice). Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes become effective constitutes acceptance.

19. Severability and Waiver

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver of our right to do so later.
